Cancellation policy
Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity:
1. About the cancellation policy
1.1 Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The cancellation period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods.
To exercise your right of withdrawal, you must inform us (Bischofskamp 18, 31137 Hildesheim , email: kundenservice@smilesecret.de ) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your notification of your exercise of the right of cancellation before the cancellation period has expired and to return the goods within the period specified below.
1.2 Consequences of revocation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs, promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise with you. We will retain a processing fee of €3.90 for processing. If acceptance is refused without a reason apparent to smile secret, or if the goods cannot be delivered, the following fees will apply:
- Shipments from DE/AT fee of 9.90 €
- Shipments from all other countries 14.90 €
We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.
You bear the direct costs of the insured return of the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling by you which is not necessary to check the quality, properties and functioning of the goods.
1.3 Exclusion or premature expiry of the right of withdrawal
The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
General information
1. Please avoid damaging or contaminating the goods. Please return the goods to us in their original packaging and unopened, with all contents intact.
2. If possible, please do not return the goods to us freight collect.
3. Please note that compliance with the above conditions is a prerequisite for the effective exercise of the right of withdrawal.
